Proposed Independent Contractor Rule

The DOL has proposed a revised rule for determining the status of a worker as an employee or independent contractor. The new rule would replace a 2021 rule which focused primarily on two of the five economic reality factors. Under the revised rule, the DOL will return to a six factor economic reality test.
